Attorneys ask federal judge to rule against U.S. policy of turning back asylum seekers
According to this article on The San Diego Union-Tribune, by KATE MORRISSEY
“A federal judge in San Diego may soon rule whether the United States is required by law to process asylum seekers when they come to ports of entry.
The case, first filed more than 4 years ago, challenges a practice that turns asylum seekers back to Mexico when they try to request protection at ports of entry along the southwest border. The policy began under the Obama administration at the San Ysidro Port of Entry before expanding to the entire border in November 2016. It was amplified under former President Donald Trump.
In a hearing Tuesday, attorneys representing asylum seekers and Al Otro Lado, a legal services organization that supports migrants in Tijuana, argued that the turnback policy is unlawful and should be permanently blocked. Attorneys from the Department of Justice argued that the policy doesn’t exist, that it is ending soon and that federal agencies can delay doing what they are legally required to do.”
